Hurricane "Sandy" has packed a punch to the Washington, D.C. - Baltimore corridor. Heavy rains and winds in excess of 60 miles an hour on the way. On Thursday, October 19th Attorney Colleen Sinclair Prosser presented a morning estate planning seminar to the staff of Northrop Grumman Federal Credit Union, as well as a lunch-time seminar to the employees of Northrop Grumman at the BWI location in Linthicum, MD.

Attorney Colleen Sinclair Prosser sponsored and participated in the Rafael's Race 5K/1K run-walk to raise funds for the school. Rafael Martins was a 4th grade student at Greenbelt Elementary School during the 2009-2010 school year. Unfortunately, Rafael passed away in October of 2009. His last day of school was a field trip to Bladensburg Waterfront Park, where he and his classmates took part in learning about nature, animal habitats and Rafael saw an American Bald Eagle soaring overhead. We are planning to use the proceeds from this event to help supplement future Field Trips for students from our school.

Jaron presented a seminar at the ARC of Prince George’s County on the importance of planning for all of life’s contingencies by having a comprehensive estate plan in place to take action when needed. She focused on how a Special Needs Trust and Letter of Intent could provide care, comfort and independence for those with developmental disabilities in years to come. A special thanks to Mary Funk, Deputy Executive Director of the ARC of Prince George’s County for coordinating the event.

Effective October 1, 2011, MOLST forms must be completed for all individuals admitted to nursing homes, assisted living facilities, hospices, home health agencies, and dialysis centers and for certain individuals admitted to hospitals. It may also be completed for anyone who wants limitations on CPR or life-sustaining treatments in any setting.

How the New Estate Tax Exclusion Affects Your Estate Plan

On December 17th, Congress revised the estate tax with a new law, TRA 2010, that sets the exclusion amount at $5 million per person for 2010 – 2012. However, this temporary adjustment to the estate tax exclusion disappears in 2013, and returns with an exclusion of $1 million per person. Effective October 1, 2010 Maryland passed the “Maryland General and Limited Power of Attorney Act.” Power of attorney documents have become more complex and now create enforceable, legal obligations for both the principal and the agent. Commonly referred to as “Loretta’s Law,” the measure was partially the result of one family member abusing the power entrusted to her by her elderly aunt. Powers of attorney should only be granted to persons whom you trust and who are able and willing to carry out your wishes.

The sudden death of Michael Jackson serves as a reminder to everyone that, no matter your age, you need to have your estate planning in order. The pop superstar died on Thursday, June 25th at 50 years old. The media is speculating as to how his estate will be handled and the future of his young children. No public statement has been made in regard to his personal planning and the media and the nation will wait anxiously to see how this unfolds. If Michael Jackson prepared a Trust the public will most likely never know the details as it will be held private, however, if he had a Will it becomes part of public record. In the state of California, a Will needs to be presented within 30 days. Jackson's assets, royalties and the amount of debt he had accumulated most likely will lead to lengthy battles over his estate.

Carolyn Bigdas article "Rethink Your Legacy" in the June issue of Money Magazine explores the five questions you should be asking regarding your estate. The article recommends the American Academys website, www.aaepa.com, as a source to find a qualified estate planning attorney. The Associate Director of Education at the Academy, Steve Hartnett, was also interviewed in the article and lent his expertise to one of the five questions. This is the fifth mention of finding a quality attorney on the American Academys members list by Money Magazine in the last 21 issues.
